Diese Allgemeinen Geschäftsbedingungen gelten für alle Käufe und die Nutzung der Software DJ Music Tagger, angeboten von Stefan Siegwart (nachfolgend „Anbieter"). Mit dem Kauf oder der Nutzung der Software erklärt sich der Nutzer mit diesen AGB einverstanden.
Gegenstand des Vertrags ist die Einräumung einer nicht-exklusiven, nicht-übertragbaren Lizenz zur Nutzung der macOS-Software DJ Music Tagger. Die Software wird als digitaler Download (DMG-Datei) bereitgestellt. Es wird keine körperliche Sache geliefert.
Die erworbene Lizenz berechtigt den Nutzer zur:
Die Lizenz ist nicht übertragbar und gilt ausschließlich für den Lizenznehmer persönlich.
Folgende Handlungen sind ausdrücklich untersagt:
Der Kaufpreis beträgt derzeit 35,00 EUR (inkl. gesetzlicher MwSt., sofern anwendbar). Die Zahlungsabwicklung erfolgt über den Zahlungsdienstleister Creem.io. Der Anbieter behält sich vor, Preise und Konditionen jederzeit für zukünftige Käufe zu ändern. Bereits erworbene Lizenzen sind von Preisänderungen nicht betroffen.
Verbrauchern steht nach § 355 BGB grundsätzlich ein 14-tägiges Widerrufsrecht zu. Bei digitalen Inhalten erlischt das Widerrufsrecht vorzeitig gemäß § 356 Abs. 5 BGB, wenn:
Der Käufer bestätigt diese Zustimmung im Rahmen des Kaufprozesses durch Aktivierung der entsprechenden Checkbox. Mit Zustellung des Lizenzschlüssels per E-Mail nach Kaufabschluss gilt der Vertrag als vollständig ausgeführt und das Widerrufsrecht ist erloschen.

Der Anbieter haftet nicht für Datenverlust, Datenbeschädigung oder sonstige Schäden, die durch die Nutzung der Software entstehen. Im Übrigen ist die Haftung des Anbieters auf Vorsatz und grobe Fahrlässigkeit beschränkt, soweit gesetzlich zulässig.
Die Software ermöglicht die optionale Anbindung an externe Dienste (MusicBrainz, Last.fm, OpenAI, Anthropic, Google, OpenRouter u.a.). Für die Nutzung dieser Dienste gelten ausschließlich die jeweiligen Nutzungsbedingungen der Drittanbieter. Durch die Nutzung von Cloud-KI-Diensten über einen eigenen API-Key können beim jeweiligen Anbieter zusätzliche Kosten entstehen, für die der Nutzer allein verantwortlich ist.
Der Anbieter behält sich vor, diese AGB sowie Funktionsumfang, Preise und Lizenzbedingungen jederzeit mit Wirkung für die Zukunft zu ändern. Über wesentliche Änderungen wird auf djmusictagger.com informiert. Die fortgesetzte Nutzung der Software nach Veröffentlichung geänderter AGB gilt als Zustimmung.
Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts. Gerichtsstand für Streitigkeiten mit Kaufleuten und juristischen Personen des öffentlichen Rechts ist der Sitz des Anbieters, sofern gesetzlich zulässig.
Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. Der Anbieter ist nicht bereit und nicht verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
These Terms of Use apply to all purchases and use of the software DJ Music Tagger, offered by Stefan Siegwart (hereinafter "Provider"). By purchasing or using the software, the user agrees to these terms.
The subject matter of the contract is the granting of a non-exclusive, non-transferable license to use the macOS software DJ Music Tagger. The software is provided as a digital download (DMG file). No physical goods are delivered.
The purchased license entitles the user to:
The license is non-transferable and applies exclusively to the licensee personally.

The current purchase price is €35.00 (incl. applicable VAT). Payment is processed via the payment service provider Creem.io. The Provider reserves the right to change prices and conditions at any time for future purchases. Already purchased licenses are not affected by price changes.
Consumers generally have a 14-day right of withdrawal under applicable law. For digital content, the right of withdrawal expires early if:
The buyer confirms this consent during the purchase process by checking the corresponding checkbox. Upon delivery of the license key by email after completion of purchase, the contract is considered fully performed and the right of withdrawal is extinguished.

The Provider is not liable for data loss, data corruption, or any other damages resulting from the use of the software. Otherwise, the Provider's liability is limited to intent and gross negligence, to the extent permitted by law.
The software enables optional integration with external services (MusicBrainz, Last.fm, OpenAI, Anthropic, Google, OpenRouter and others). The respective terms of service of the third-party providers apply exclusively to the use of these services. Using cloud AI services via your own API key may incur additional costs at the respective provider, for which the user is solely responsible.
The Provider reserves the right to modify these Terms of Use as well as the scope of features, prices, and license conditions at any time with effect for the future. Material changes will be announced at djmusictagger.com. Continued use of the software after publication of amended terms constitutes acceptance.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The jurisdiction for disputes with merchants and legal entities under public law is the Provider's place of business, to the extent permitted by law.
Should individual provisions of these Terms of Use be invalid, the validity of the remaining provisions shall remain unaffected. The Provider is not willing and not obligated to participate in dispute resolution proceedings before a consumer arbitration board.
